Terms of Service

Welcome to SendSawa. These Terms of Service ("Terms") govern your access to and use of the SendSawa platform, including our website, storefront builder, WhatsApp commerce tools, and related services (collectively, the "Service"), operated by SendSawa ("we", "our", or "us").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By using SendSawa, you represent that you meet these requirements. The Service is intended for business use by merchants, entrepreneurs, and sellers.

2. Account Registration

  • You must provide accurate, complete, and current information when creating your account.
  • You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
  • You must notify us immediately at support@sendsawa.com if you suspect unauthorised access to your account.
  • You may not share your account credentials or create accounts on behalf of others without their authorisation.
  • We reserve the right to refuse registration or suspend accounts at our discretion.

3. The Service

SendSawa provides tools that allow merchants to create online storefronts, manage products and inventory, receive orders via WhatsApp, and accept payments. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where possible.

4. Acceptable Use

You agree not to use the Service to:

  • Sell illegal, counterfeit, or prohibited goods or services
  • Engage in fraud, deception, or misleading practices towards customers
  • Violate any applicable law or regulation, including Nigerian law
  • Transmit spam, unsolicited messages, or malicious code
  • Attempt to gain unauthorised access to our systems or another user's account
  • Reverse-engineer, copy, or create derivative works of the Service
  • Use the Service in any way that disrupts, damages, or impairs its operation

We may remove any content or suspend any account that violates these rules without prior notice.

5. Merchant Responsibilities

As a merchant using SendSawa, you are solely responsible for:

  • The accuracy of your product listings, descriptions, and pricing
  • Fulfilling orders and honouring your stated return/refund policies
  • All customer interactions and disputes
  • Complying with applicable consumer protection, tax, and trade laws in your jurisdiction
  • Ensuring you have the right to sell any products listed on your store

6. Payments and Subscriptions

Subscription plans

SendSawa offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis as described at the time of purchase. All fees are stated in Nigerian Naira (NGN) unless otherwise specified.

Billing

By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis. You are responsible for keeping your billing information up to date.

Refunds

Subscription fees are non-refundable except where required by applicable law. If you cancel, your plan remains active until the end of the current billing period.

Price changes

We may change subscription prices with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

7. Intellectual Property

The Service, including its design, code, trademarks, and content created by us, is owned by SendSawa and protected by intellectual property laws. You may not use our name, logo, or branding without prior written permission.

You retain ownership of all content you upload to the Service (product images, descriptions, etc.). By uploading content, you grant us a non-exclusive, royalty-free licence to display and host that content solely for the purpose of providing the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Third-Party Services

The Service integrates with third-party platforms including WhatsApp, payment processors, and authentication providers. Your use of those services is subject to their own terms and policies. We are not responsible for the availability or conduct of third-party services.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, SendSawa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless SendSawa, its officers, employees, and partners from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

You may close your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion, with or without notice.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will also send an email notification. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
